After the adoption of the law banning short-term rentals in Berlin, there were people who tried to challenge the ban in court. Three plaintiffs reside most of the time in the North of Germany, Italy and Denmark, respectively, owned property in the German capital. Their apartments and houses they are not used regularly. The objects were not acquired for the purpose of earning income.
Due to the periodic visits of the owners, the property could not be offered for a long term rent. The judges decided that in this case for owners allowed to rent out their apartments to tourists (in short-term rent) at certain periods.
This decision of the court cannot be considered a complete lifting of the ban of short-term rentals through services like Airbnb. However, there is a real precedent. And that means that other people will be able to use their second home in Berlin in the same way.
